The court was hearing a petition filed by Prajapati's mother Narmada Bai, who alleged that her son was killed in a fake encounter by Gujarat Police as he was a key eyewitness to the Sohrabuddin Shaikh encounter.
The apex court had on April 8, 2011 transferred the probe in the case to the CBI. Shaikh was also killed in an alleged fake encounter by Gujarat Police and probe of that case was also carried out by the CBI.

The stalemate in the Monsoon Session of Parliament may continue today after both the Congress and the BJP refused to budge from their stance over the coal-gate scam.
Upping its ante, the BJP has accused Congress of trying to hide the truth about the issue and said it will lodge a complaint with the Rajya Sabha Chairman.
"The Congress party is now trying to hide the truth about the coal scam and has removed all questions related to the coal department from Parliament website, this shows their mindset," party's national spokesperson Prakash Javadekar said.
